Organizations consult with the Office of the General Counsel regarding matters of post-employment requirements on terminated individuals.

Practitioner Notes

Some departing employees may have post-employment obligations — things like nondisclosure agreements that continue after they leave, or restrictions on working for competitors. These need to be clearly communicated during exit processing.

Example 1: During the exit interview, review continuing obligations with the departing employee: nondisclosure agreements, non-compete clauses, restrictions on using proprietary information, and requirements to return all copies of sensitive data. Have them sign an acknowledgment of these ongoing obligations.

Example 2: Maintain a post-employment obligations tracker that records each former employee's name, departure date, and the specific agreements that remain in effect. Set calendar reminders for when restrictions expire so your legal team can follow up if needed.
